Dear West Seneca School Community,

Our schools have and will continue to be safe havens for children. Daily, we strive to provide a welcoming environment where all students can thrive academically and social-emotionally.

I am writing regarding concerns related to possible inquiries from representatives of the U.S. Immigration and Customs Enforcement (i.e. “ICE”), including concerns related to requests to meet or interview students, or to obtain access to student records. Across our state and nation, this is causing some families to not send their child or children to school.

The New York State Department of Education has provided guidance for schools. You may access the entire guidance document on the NYSED website, which is linked here. I have summarized some key facts below.

  • All children ages 5-21 are entitled to a free public education regardless of immigration status.

  • Schools are prohibited from collecting information related to a student’s immigration status. Therefore, at the time of registration, we do not seek proof of citizenship nor do our school records indicate citizenship status.

  • The Federal Education and Privacy Rights Act (FERPA) of 1974 prohibits the disclosure of personally identifiable information without parental consent unless required by a judicial order or lawfully issued subpoena.

  • Law enforcement officers may not remove a student from school property or interrogate a student without the consent of the student's parent/guardian, except in limited circumstances such as addressing an imminent safety situation or in response to specific documentation such as a warrant.

The West Seneca Central School District will continue to remain compliant with all laws and regulations while protecting the safety and well being of our students. You entrust us with the safety of your child/children, and this is a responsibility that is of the utmost importance. We value, support and educate all children in our care regardless of their background or circumstances. Public education is education for all, and the New York State Department of Education has recently reiterated our commitment to this mission.

Should you have any questions or concerns, please feel free to reach out to us. Thank you for your continued partnership to support our students.

Sincerely,

Lisa M. Krueger, Ed.D.
