Understanding FID (Flexible Instruction Days) and Virtual Days
LEAs may change the modality of instruction (from in-person to a/synchronous) for some or all of their students when it is most appropriate. When doing so, similar to operating a virtual academy, there is no special notification to or permission from PDE via PIMS or CAD required. If an LEA chooses to change the modality of instruction, they might call it a virtual day or a remote day – calling it a FID, however, binds the LEA to specific program requirements set forth in law. Additionally, the LEA must have the FID application approved in order to call a day a FID.
The implementation of instructional programs/modalities that may count towards the instructional time requirements is a local decision to be made in cooperation with the Board and in consultation with the solicitor. When making decisions related to the provision of instructional time (including when choosing to implement a virtual/remote learning day), LEAs should consider issues such as (not an exhaustive list):
The provision of planned instruction needed to attain the relevant academic standards set forth in Chapter 4;
The implementation of systems of tracking attendance and instructional time;
The use of certified school employees to direct the instructional activities (22 Pa. Code § 11.2)
The provision of FAPE; and
The equity of access to instruction for all students.
Finally, consider instructional time in terms of 180/990. LEAs can reduce their school calendar by one or more days (i.e., not make up a day or not change to remote instruction) if they will have at least 180 days or 990/900 hours at the end of the school year.
