Committed to a Safe and Supportive School Environment

Tuesday, January 28, 2025

Dear District 25 Community,

I want to take a moment to address the recent decision by the federal Department of Homeland Security (DHS) to rescind its policy that restricted immigration enforcement in “protected areas/sensitive locations” such as schools.

In Arlington Heights School District 25, we firmly believe, as the Illinois State Board of Education (ISBE) does, that “schools should be a safe haven for all students where students should be able to learn without fear.”

To that end, we have provided clear guidance to our front office staff and building administrators on how to handle situations should Immigration and Customs Enforcement (ICE) or other immigration representatives arrive on school property. Our priority remains to ensure that every child and family feels safe, valued, and supported in our schools.

We are also in close contact with our legal counsel to ensure that we fully understand our rights as a district and the rights of our students. In addition, the Illinois State Board of Education has provided non-regulatory guidance and resources to public schools, which you can access here.

The following guidance and statements are based on those resources and legal advisement:

1. The Right to Education
Every child is entitled to a free public education, regardless of their background or immigration status. As outlined by the U.S. Supreme Court’s decision in Plyler v. Doe, District 25 does not inquire about or collect information regarding a student’s or family’s immigration status during enrollment. Also, schools have no legal right or obligation to enforce immigration laws.

2. Student Privacy Protections
Federal and state privacy laws, including the Family Educational Rights and Privacy Act (FERPA) and the Illinois School Student Records Act (ISSRA), protect student information. These laws prevent the sharing of student records with law enforcement or immigration officials without proper legal documentation or parental/guardian consent.

3. Access to Students
While recent updates to federal guidelines have adjusted restrictions on immigration enforcement in specific areas, including schools, law enforcement officials—such as Immigration and Customs Enforcement (ICE)—still generally must present a valid judicial warrant or parental consent before accessing school buildings or interacting with students.

The safety and well-being of all our students are our highest priorities. If you have any questions or concerns, please don’t hesitate to reach out to your school’s administration or the district office.

Thank you for your partnership in fostering a supportive and inclusive environment for all students.

As always, Together Today 2 Transform Tomorrow,
