Know Your Rights!
With the recent executive orders about immigration, many have questions about what my rights are and how schools are keeping our students safe.
ALL students have the existing protections:
- Family Educational Rights and Privacy Act (FERPA)
- Protects students from having their records released without their consent
- The Plyler vs. Doe Case
- States cannot constitutionally deny students a free public education on account of their immigration status
- Fourth Amendment
- Constitutional rights against unwarranted search
Every staff member of the HSD has had training on what to do if ICE comes to the school. So far, we have no indications that ICE will be coming to schools in Vermont. However, we want to be prepared and will continue to work with our legal counsel to ensure that we are following the law and doing all we can to protect our students.
Here are some additional resources for families who may need extra support.
You have constitutional rights:
DO NOT OPEN THE DOOR if an immigration agent is knocking on the door.
DO NOT ANSWER ANY QUESTIONS from an immigration agent if they try to talk to you. You have the right to remain silent.
DO NOT SIGN ANYTHING without first speaking to a lawyer. You have the right to speak with a lawyer.
If you are outside of your home, ask the agent if you are free to leave and if they say yes, leave calmly.
Carry a “Know Your Rights!” Card that says:
I am choosing to remain silent.
I want to contact a legal representative.
I will not sign documents before my legal representative reviews them.
I do not give you permission to enter my property OR search my belongings.
If I am under arrest, I want to make a phone call.
