Important Information Regarding Vaping
The Texas State Legislature passed House Bill 114 this past session, requiring school districts to order a mandatory placement in the Disciplinary Alternative Education Program (DAEP), subject to Texas Education Code (TEC) 37.009(a), for a student who:
- possesses, uses, or is under the influence of, or sells, gives, or delivers to another person marijuana or tetrahydrocannabinol, or
- possesses, uses, sells, gives, or delivers to another person an e-cigarette (vape).
A mandatory DAEP placement will have a significant impact on a student’s school year. Direct instruction in the classroom is important for student success. Additionally, students in DAEP are prohibited from participating in or attending extracurricular activities, athletics, fine arts, or any other events taking place on campus during that time.
